Terms and Conditions: Sunwise Payout Wheel

This document (the “Terms”) governs the use of the feature known as “Payment Roulette” (the “Roulette”), offered by Sunwise Software Inc. (“Sunwise”) to account holders whose subscription is in a pending payment status, in order to grant a temporary extension to continue using the platform while the corresponding payment is being processed.
Use of the Roulette is voluntary and is subject to express acceptance of these Terms by checking the consent box provided prior to spinning.

• Account: The Sunwise account associated with an active subscription or one with a pending payment
  .
• Account Holder: the individual or legal entity that holds the Account and is contractually responsible to
  for the subscription with Sunwise.
• User: any person who accesses the Account using the credentials provided by
  or the Owner, including individuals authorized by the Owner.
• Pending payment: a subscription status in which the scheduled payment could not be processed
  and is pending resolution.
• Spin: the action of activating the Roulette from the Account, once per pending payment cycle
  , unless Sunwise indicates otherwise.
• Extension: the number of additional days, randomly determined within a
  range of 1 to 5 days, during which the Account may continue to use the platform even though payment is pending.

1. The Roulette will be visible and available to the Owner from the moment the account enters the "Payment Pending" status until said subscription changes to "Canceled" status, whichever occurs first.

2. The result of the Spin is random, within a range of one (1) to five (5) days, and
is not subject to negotiation, claim, or repeat, except in the case of a technical error attributable to Sunwise.

3. The calculation of the Extension period begins on the exact date and time of the Spin, and
not on the date the Account entered the “Pending Payment” status.
‍
4. Upon expiration of the Extension period, if the payment has not been settled, access to
the platform may be suspended, and the subscription may be canceled in accordance with the general terms of service.

5. Use of the Roulette feature does not alter the amount, frequency, or other financial terms
of the subscription, unless expressly stated otherwise in writing.

Before each spin, the User must explicitly check a consent box; without doing so, the Wheel cannot be used. By checking this box, the User declares that:

• Acts on behalf of the Owner or has the Owner's authorization to use the account
• You have read, understood, and fully accept these Terms.
• Please understand that the outcome of the draw is random and that Sunwise does not guarantee a specific number of extension days.

• The Roulette is a discretionary benefit and does not constitute an acquired right, a guarantee,
  , a contractual obligation, or a permanent obligation on the part of Sunwise.
  

• Sunwise may modify, suspend, or discontinue the Roulette at any time and
  without prior notice, without incurring any liability to the Owner or the Users.
  

• The extension granted does not exempt the Owner from their payment obligation; it merely
  temporarily extends access to the platform.
  

• Sunwise shall not be liable for any losses, damages, or harm resulting from the
  suspension or cancellation of access to the platform once the Extension has expired.
  

The data collected in connection with the Giro (user, date, time, and other technical metadata) will be processed in accordance with Sunwise’s Privacy Notice, available at https://www.sunwise.io/privacy, and will be retained for as long as necessary to comply with legal and contractual obligations or to provide verification to third parties, including financial institutions.

Sunwise may update these Terms at any time. The current version will always be available at http://www.sunwise.io/terminos-y-condiciones-ruleta, and the date of the last update will be indicated. Your continued use of the Roulette after any changes constitutes your acceptance of the updated Terms.
