("SUNWISE"), a company incorporated under the laws of the State of Delaware, United States of America, is committed to the protection of personal data and complies with applicable laws in the countries where it operates, including the data protection laws in force in each jurisdiction. In the event of a conflict between laws, the laws of the State of Delaware, United States of America, shall prevail.

At Sunwise, we recognize that the privacy of your personal data is essential to building a relationship of trust with you. Therefore, we are committed to safeguarding your data in accordance with the highest security standards, implementing the necessary controls to protect it against loss, alteration, unauthorized use, or unauthorized access.
The personal data we collect will be treated confidentially and used exclusively for administrative, operational, and statistical purposes related to our relationship with you. Under no circumstances will sensitive information be made public or used for purposes other than those indicated here. Depending on the circumstances under which your data was collected, it may be used for the following purposes:

1. Primaries

• The administration and general management of SUNWISE with the objective of providing professional services.
• The contracting and/or acquisition of products and services required by SUNWISE to fulfill its social object.
• Establish contact with the persons who have requested it through our website www.sunwise.io or by any available means of communication.
• Answering questions and comments.
• Respond to job applications that SUNWISE receives from you.
• If necessary, establish a subsequent legal relationship, or for the provision of our services.

2. High Schools

• Sending of information that SUNWISE considers to be of your interest, as well as news, communications or publicity of SUNWISE.
• Sending your information by SUNWISE to persons or companies that you consent to obtain financial products and/or services.

• So that you can exercise your ARCO rights and/or revoke your consent.

The personal data we collect is as follows:

1. Identification data: contact name, date of birth, address, phone number, email address, company name, etc.
2. Billing information: Tax ID number (RFC), address, bank account, etc.
3. Information regarding the company or the person you represent, pertaining to financial capacity and solvency, in relation to interest in SUNWISE’s direct and indirect services.

And will be obtained through:

1. The information you enter on the SUNWISE website.
2. From the documents you submit or send to SUNWISE via the website when requesting information about the services provided by SUNWISE.

Sunwise retains personal data for as long as the service relationship remains active and for up to 6 months after the account is closed or the service relationship ends, unless applicable law requires or permits a longer retention period. Data processed through AI integrations and connected tools is not stored beyond the scope of the user’s existing account records within the Sunwise platform. Users may request the early deletion of their data by exercising their ARCO rights, as described in this notice.

When authorized users interact with Sunwise through AI integrations, connected assistants, APIs, or other connected tools, Sunwise may process and return certain categories of information strictly necessary to perform the requested operation within the platform. Such information may include:

• Internal resource identifiers associated with contacts, projects, proposals, companies, branches, assigned agents, and other related records.
  

• Contact management data such as name, email address, phone number, and company information.
  

• Commercial and project-related information, including project names, proposal details, financial figures, technical system specifications, energy consumption data, and commercial projections.
  

• Project statuses, tags, or categories configured by users or organizations within the platform.
  

When users interact with Sunwise through our internal chat, the data necessary to fulfill the requested operation is transmitted to and processed by OpenAI, L.L.C. (United States), in accordance with OpenAI’s Privacy Policy (available at https://openai.com/policies/privacy-policy). Sunwise does not control OpenAI’s independent data processing practices and recommends that users review that documentation directly.
By using our MCP (Model Context Protocol) to connect an LLM of your choice, you grant your express consent for that model to access and process the necessary information from Sunwise to execute the requested operations. The Sunwise authentication system will request the necessary permissions to establish this connection. In this scenario, the user is solely responsible for obtaining prior consent from any third parties whose data may be processed, and for reviewing the privacy policies of the selected LLM provider. SUNWISE shall not be liable for any use that third parties make of the data transmitted through these independent integrations.

SUNWISE is not liable for any damage, harm, or loss incurred by the user due to system, server, or Internet failures. The user may not hold SUNWISE liable or demand compensation for lost profits arising from damages resulting from technical difficulties or failures in the systems or the Internet. SUNWISE does not guarantee uninterrupted access to or use of its system. SUNWISE shall not be liable for any installation services provided by its users to third parties.

In addition to exercising your ARCO rights as established by law, in order to allow you to restrict the use and disclosure of your Personal Data solely for marketing, advertising, or commercial solicitation purposes, we offer you the option, free of charge, send a request to the email address hola@sunwise.io to register on the “Exclusion List” maintained by SUNWISE, so that the Personal Data you specify will not be processed by us for marketing, advertising, sending information of interest to you, or commercial prospecting purposes.

We are committed at all times to establishing, maintaining, and safeguarding your personal data through legal, technological, and administrative security measures that we employ to protect against damage, loss, alteration, destruction, or the unauthorized use, access, or processing of your personal data, as well as to implementing a strict confidentiality system with respect to such data, and to immediately inform you of any breach of such security measures and/or confidentiality, provided that such breaches significantly affect your economic or moral rights.

USE OF COOKIES

The SUNWISE website may use cookies to analyze traffic, improve the user experience, and optimize our services. Cookies are small text files that are stored on the user’s device when browsing our site.
Users can configure their browser to reject all cookies or to receive a notification when a cookie is sent. However, some features of the site may not be available if cookies are disabled.

As the owner of your personal data, you have the right to exercise your rights of access, rectification, cancellation, and objection (“ARCO Rights”) with SUNWISE. SUNWISE will receive and review the request and corresponding documentation, acknowledging receipt on a copy thereof, and will determine the admissibility or inadmissibility of the request within the timeframe established by law.

We reserve the right to make changes or updates to this privacy notice at any time, in order to comply with new legislation, internal policies or new requirements for the provision or offering of our services or products. These modifications will be available to the public on our website www.sunwise.io.

With the granting of its tacit or express consent and/or with the nonopposition to the present warning of privacy, it is forced to remove in peace and safe to SUNWISE, as well as to any third properly contracted or to contract with clauses of confidentiality of information and protection of data of third, either national or foreign, of any judgment or claim that is entered or tried against him by virtue of the collection, treatment and transfer of the personal data, sensitive personal data and/or financial data and/or patrimonial data provided.
