SUNWISE SOFTWARE INC, ( "SUNWISE), in compliance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals (the "Law") and the Regulation of the Federal Law for the Protection of Personal Data in Possession of Individuals (the "Regulation"), is responsible for the processing of your personal data.

Your personal data may be used depending on the circumstances in which they were collected, and the relationship with you, provided that it is for the following purposes:

1.Primary

• The administration and general management of SUNWISE with the objective of providing professional services.
• The contracting and/or acquisition of products and services required by SUNWISE to fulfill its social object.
• Establish contact with the persons who have requested it through our website www.sunwise.io or by any available means of communication.
• Answering questions and comments.
• Respond to job applications that SUNWISE receives from you.
• If necessary, establish a subsequent legal relationship, or for the provision of our services.
• Keep in touch with you.

2.Secondary

• Sending of information that SUNWISE considers to be of your interest, as well as news, communications or publicity of SUNWISE.
• Sending your information by SUNWISE to persons or companies that you consent to obtain financial products and/or services.
• Sending notices regarding changes to this Privacy Notice.
• So that you can exercise your ARCO rights and/or revoke your consent.
• Use of your market, industrial, production and consumption information by SUNWISE to generate statistics, which may be shared with SUNWISE partners.

If you do not consent to any or all of the above purposes, please let us know in writing when your information is collected and/or by sending an e-mail to hola@sunwise.io specifying the purpose(s) for which you do not consent to your data being processed.

The personal data we collect are the following:

1.Identification data: contact name, date of birth, address, telephone number, e-mail, company name, etc.
2. Invoicing data: RFC, address, bank account, etc.
3. Data of the company or person that represents, relative to the capacity and economic solvency, as far as the interest in the direct and indirect services of SUNWISE.

And they will be obtained by means of:

. The information that you enter in the Internet page of SUNWISE.
2. The documents that you give or send to SUNWISE through the web page during the request of information on the services that SUNWISE provides.

Sunwise retains personal data for as long as the service relationship remains active and for up to five (5) years after the account is closed or the service relationship ends, unless applicable law requires or permits a longer retention period. Data processed through AI integrations and connected tools is not stored beyond the scope of the user’s existing account records within the Sunwise platform. Users may request the early deletion of their data by exercising their ARCO rights, as described in this notice.

When authorized users interact with Sunwise through AI integrations, connected assistants, APIs, or other connected tools, Sunwise may process and return certain categories of information strictly necessary to perform the requested operation within the platform. Such information may include:

• Internal resource identifiers associated with contacts, projects, proposals, companies, branches, assigned agents, and other related records, when necessary to maintain operational context across subsequent actions, updates, reassignments, or chained interactions between tools.
  

• Contact management data such as name, email address, phone number, and company details, when such information is necessary to search for, identify, manage, or update platform records requested by the user.
  

• Commercial and project-related information, including project names, proposal details, financial figures, technical system specifications, energy consumption data, and commercial projections.
  

• Project statuses, tags, or categories configured by users or organizations within the platform, including custom conventions, business process tags, and user-defined values.
  

These identifiers and fields are returned only when they are functionally necessary to complete CRM workflows, projects, proposals, or administrative actions requested by the user. The internal identifiers returned by the platform are solely operational references within Sunwise and do not constitute authentication credentials, security secrets, or autonomous access mechanisms outside the user’s authorized context. Sunwise applies data minimization principles to connected integrations and strives to avoid returning technical metadata unrelated to the action requested by the user.
When users interact with Sunwise through OpenAI-powered integrations (such as ChatGPT or the OpenAI API), the data necessary to fulfill the requested operation is transmitted to and processed by OpenAI, L.L.C. (United States), subject to OpenAI’s Privacy Policy available at https://openai.com/policies/privacy-policy. Sunwise does not control OpenAI’s independent data processing practices and recommends that users review OpenAI’s privacy documentation directly.

SUNWISE is not responsible for any damage or loss to the user caused by system, server or Internet failures. The user will not be able to impute him responsibility nor to demand payment by dismissed profit, by virtue of damages resulting from technical difficulties or failures in the systems or Internet. SUNWISE does not guarantee the access and uninterrupted use of its system. The mobile application can eventually not be available due to technical difficulties or failures in the Internet, or by any other circumstance beyond the control of SUNWISE; in such cases we will try to reestablish it as soon as possible without any responsibility. SUNWISE will not be responsible for any errors or omissions contained in its web site and mobile application. SUNWISE will not be responsible for the installation service provided by its users to third parties.

Besides the exercise of ARCO Rights established in the Law, with the purpose that you can limit the use and disclosure of your Personal Data only for marketing, advertising or commercial prospecting purposes we offer you, that for free, you can send to the e-mail address hola@sunwise.io the request to register in the "Exclusion List" that SUNWISE maintains, in order that the Personal Data that you indicate, are not treated for marketing, advertising, shipment of information of your interest, or of commercial prospection by our part.

We are committed at all times to establish, maintain and protect your personal data with legal, technological and administrative security measures, used by us, against damage, loss, alteration, destruction or unauthorized use, access or treatment of your personal data, as well as to implement a strict system of confidentiality with respect to them, and to inform you immediately of any violation of such security measures and/or confidentiality, provided that they significantly affect your economic or moral rights. Also, we commit ourselves to that SUNWISE and/or any third properly contracted or to be contracted, with clauses of confidentiality of information and protection of data of third parties that is transferred to them their information, knows the present Warning of Privacy, maintains in the treatment and transference of their personal data the measures of security and confidentiality indicated by the Law. Conscious that the protection of the privacy and confidentiality of the sensitive personal data is fundamental, SUNWISE maintains strict levels of security that restrict the Treatment of the personal data exclusively for the purposes for which they were obtained, as well as to protect them of the consultation, modification, loss, copy, use, access, robbery, alteration, disclosure, damage, destruction and any Treatment that deviates from the authorized thing in the present Warning. SUNWISE makes a continuous effort to implement and apply new security measures to its electronic database.

As holder of your personal data, you have the right to exercise before the Person in charge of Personal Data of SUNWISE, the rights of access, rectification, cancellation and opposition ("ARCO rights"). You can also revoke all or part of the consent given for the processing of your personal data. You may exercise these rights by sending a request to the following e-mail address hola@sunwise.io or at the address set forth in this Privacy Notice, as required by law. If the request is made via e-mail, it is necessary that your request also be accompanied by a copy of the documentation required by the Law. SUNWISE will receive and will review through the Person in charge of Personal Data of SUNWISE that the request and corresponding documentation that accompanies it is complete, accusing of received in the copy of the same one. Also, it will determine the origin or inappropriateness of the application in the term established by the Law, and will make available to the applicant, in writing, the corresponding determination in the address indicated in this Privacy Notice, or to the electronic address from which the application was received. The deadlines for responding to your request and for implementing the corresponding changes will be made in accordance with the terms set forth in the Act. It is important to inform you that you may exercise the rights set forth in this notice at any time, however, certain personal data and/or sensitive personal data may be exempt from limitation, access, rectification, cancellation or opposition under the Law; for example, the obligation to maintain certain information required by the Ministry of Finance and Public Credit.

We reserve the right to make changes or updates to this privacy notice at any time, in order to comply with new legislation, internal policies or new requirements for the provision or offering of our services or products. These modifications will be available to the public on our website www.sunwise.io.

With the granting of its tacit or express consent and/or with the nonopposition to the present warning of privacy, it is forced to remove in peace and safe to SUNWISE, as well as to any third properly contracted or to contract with clauses of confidentiality of information and protection of data of third, either national or foreign, of any judgment or claim that is entered or tried against him by virtue of the collection, treatment and transfer of the personal data, sensitive personal data and/or financial data and/or patrimonial data provided.

If you consider that your right of protection of personal data has been harmed by some conduct of our employees or of our actions or answers, you presume that in the treatment of your personal data there is some violation to the dispositions anticipated in the Law, you will be able to interpose your doubt, complaint or corresponding denunciation before the Personnal Data Responsible of SUNWISE in the e-mail hola@sunwise.io.
